1. Preamble
These General Terms and Conditions of Sale apply to all transactions made via the NCT GROUP website, accessible at www.nocturne-ravewear.com . These conditions govern the sale of all products and services by NCT GROUP to its customers.
2. Acceptance of the Conditions
By ordering on our site, you unreservedly accept these General Conditions of Sale which prevail over any other document, unless explicitly agreed otherwise in advance.
3. Products and Services
The products and services offered are those listed on the NCT GROUP website, within the limits of available stocks. Each product is accompanied by a description drawn up by the supplier; the photographs in the catalogue are as faithful as possible but cannot ensure perfect similarity with the product offered.
4. Orders
The contractual information is presented in French and will be confirmed at the latest at the time of validation of the order. NCT GROUP reserves the right not to record a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.
5. Price
The prices of our products are indicated in euros excluding taxes and applicable on the day of the order. NCT GROUP reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the rate in force at the time of validation of the order.
6. Payment Terms
Payment is due immediately on the order date. You can pay by credit card or bank transfer. Cards issued by banks domiciled outside the EU must be international.
7. Delivery
Delivery is made to the address you indicated when ordering. The risks will be your responsibility from the date on which the products ordered leave our premises.
8. Right of Withdrawal
In accordance with current legislation, you have 14 days from receipt of your products to exercise your right of withdrawal from NCT GROUP without having to provide reasons or pay a penalty.
9. Guarantees and After-Sales Service
All products supplied by NCT GROUP benefit from the legal guarantee of conformity and the guarantee of hidden defects. In the event of non-conformity of a product sold, it may be returned to NCT GROUP which will take it back, exchange it or refund it.
10. Liability
NCT GROUP, in the online sales process, is only bound by an obligation of means; its liability cannot be incurred for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, interruption of service, or other involuntary problems.
11. Intellectual Property
All elements of the NCT GROUP website are and remain the intellectual and exclusive property of NCT GROUP. No one is authorized to reproduce, exploit, or use in any capacity whatsoever, even partially, elements of the site whether in the form of photos, logos, visuals or text.
12. Personal Data
NCT GROUP reserves the right to collect information about buyers including by using cookies, and, if it wishes, to transmit the information collected to commercial partners.
13. Archiving - Proof
NCT GROUP will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy. The computerized records of NCT GROUP will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
14. Dispute Resolution
These online sales conditions are subject to Bulgarian law. In the event of a dispute, jurisdiction shall be assigned to the competent courts of Sofia, notwithstanding multiple defendants or third-party claims.
